ChemicalStore Inc. (herein after ChemicalStore or CHEMICALSTORE) is engaged in the business of “Online Sales” of “Science Education Products, metals, chemicals, Laboratory Supplies and Industrial products” using the drop shipping method. By using this website or any of the products or services offered in this website, you (the "Customer") agree to be bound by the following terms and conditions which together with any online order or fully executed contract by ChemicalStore and the Customer, comprises the entire agreement ("Agreement") between ChemicalStore and the Customer.
1. Acceptance – ALL SALES ARE SUBJECT TO AND EXPRESSLY CONDITIONED UPON THE TERMS AND CONDITIONS CONTAINED HEREIN, AND UPON CUSTOMER'S ASSENT THERETO. NO VARIATION OF THESE TERMS AND CONDITIONS WILL BE BINDING UPON CHEMICALSTORE UNLESS AGREED TO IN WRITING AND SIGNED BY AN OFFICER OR OTHER AUTHORIZED REPRESENTATIVE OF CHEMICALSTORE.
2. Product Representation / Specifications – Every effort is made to ensure accuracy in our product images, descriptions, and pricing prior to publication. However, due to occasional changes made by vendors after the date of publishing, the physical appearance of items may change or vary in color from what is shown in our catalog or website. We assure the items you receive will satisfy all product specifications and requirements. If a typographical error in pricing should occur, we are not obligated to honor the misprinted price. Please check our website for the most recent updates to product images, descriptions, and pricing. Product specifications are subject to change without prior notice. We do not provide additional documentation with our products, so documents such as COA, Kosher certificate, Halal Certificate, Gluten free certificate, Non-GMO certificate, Organic certificate, Certificate of compliance, vegan statement, cruelty free statements and similar documents will never be included with our products.
3. Delivery – The seller fulfills his obligation to deliver when he has handed over the goods into the charge of the carrier (USPS, FedEx, UPS, DHL, etc.).
4. Damaged Shipments – Please inspect your ChemicalStore shipment upon receipt. If any external damage is noticed, accept the shipment only after the driver has noted the damage on both his and your copies of the delivery receipt and you have requested an inspection by the carrier. Keep all containers and packing material for inspection. If, upon opening a shipment, you find a shortage or damage, you must request inspection by the carrier within seven (7) days of delivery or you will relinquish your right to make a claim. You must also report any product shortage or damage to ChemicalStore via email and phone call. ChemicalStore reserves the right to repair a damaged product, where applicable, before replacement or credit is determined.
5. Payment Terms – All online orders must be prepaid. For buyers with an open account, individual invoices, net thirty (30) terms; summary invoices, if any, will be due as agreed.
6. Sales Tax – Sales taxes where applicable (local, state or federal) will be added to the invoice price. If you are exempt from sales tax, please provide proper documentation before placing your order. Upon receipt of your tax exempt documents we will update your account to tax exempt status and we will no longer charge you sales tax as long as we have your valid, updated tax exempt documents on file. Tax exemption does not apply to previous orders and previously collected taxes are not refundable.
- Order Cancellation Policy – Any online, faxed or mailed order may be cancelled by the customer's request before shipment. Customers must call during business hours and speak with a manager and send an email requesting cancellation. Cancellation fee is $3.00 plus 5% of the total invoice. Custom or special orders carry a 30% cancellation fee.
Many orders require authentication, address verification and buyer qualification. If we cannot verify an order within 15 days, it may be cancelled and subject to cancellation fees.
8. Product Return Policy (See part 9 for warranty)
(a) Single units up to $99 may be returned unopened within 7 days.
(b) Returns over $99 or multiple quantities require an RMA within 30 days.
(c) All returns must be authorized by ChemicalStore and include customer and order details.
(d) Non-returnable items include perishables, special orders, expired or discontinued products, or items not purchased from ChemicalStore.
(e) Hazardous material returns must comply with DOT regulations.
(f) Return fees may include bank fees, inspection/testing fees, restocking fees, and disposal fees.
(g) Carrier returns will result in refund of product price only. Shipping is non-refundable.
- Product and Service Warranties and Limitation of Liability
ChemicalStore warrants products only to original customers for manufacturer warranty period or 60 days.
ALL OTHER WARRANTIES ARE DISCLAIMED. LIABILITY IS LIMITED TO THE PRICE PAID FOR THE PRODUCT OR SERVICE.
10. Indemnification – Customer agrees to indemnify ChemicalStore against misuse or breach.
11. Proprietary Information – Confidential information must be protected by both parties.
12. Miscellaneous – Governing law is the State of Delaware. Venue shall be Delaware courts.
